Terms of Service

OMEMRA helps you collect memories, photos, and stories from the people who matter to you, and turns them into AI-assisted storybooks and keepsakes. Account holders ("Organizers") can invite family and friends ("Contributors") to add photos, written stories, voice notes, and videos to a shared "chapter," which OMEMRA compiles into a storybook that can be viewed digitally and, where offered, ordered as a printed keepsake.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an OMEMRA account. You're responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Contributors invited to a chapter without creating a full account are still bound by these Terms with respect to any content they submit.

"User Content" means the photos, text, stories, audio, video, and other material that you or your Contributors upload to OMEMRA. You retain ownership of your User Content. By submitting User Content, you grant OMEMRA a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display that content solely to operate, provide, and improve the Service for you and the people you've invited to your chapter — for example, generating AI illustrations, formatting a storybook layout, or producing a printed copy you order.

You represent that you have the necessary rights to upload each piece of User Content, and, where it depicts another identifiable person, that you have their permission to share it through OMEMRA. You're solely responsible for your User Content and for inviting Contributors appropriately.

OMEMRA uses artificial intelligence to transform photos and stories into illustrations, layouts, and narrative text. AI-generated output is provided "as is" and may not perfectly represent the people, places, or events depicted in your source material. You should review AI-generated content before including it in a final storybook or ordering a printed product. OMEMRA does not claim that AI-generated illustrations are accurate depictions of real individuals.

When you invite someone to contribute to a chapter, you're responsible for ensuring that invitation is appropriate and that the Contributor understands their content may be visible to other invited members of that chapter, and to you as Organizer. OMEMRA is not a public platform — content is only shared with people you explicitly invite — but we cannot control what an Organizer or Contributor does with content after it's shared with them (for example, downloading or printing it independently).

You agree not to use the Service to:

• Upload content that is unlawful, infringing, defamatory, or that you don't have the right to share;
• Upload content depicting a minor without appropriate parental or guardian consent;
• Harass, impersonate, or invade the privacy of any person;
• Attempt to access another user's account, chapter, or content without authorization;
• Reverse-engineer, scrape, or interfere with the normal operation of the Service; or
• Use the Service for any commercial purpose we haven't authorized in writing.

We may remove content or suspend accounts that violate these Terms, with or without notice.

Digital storybooks and printed keepsakes (books, cards, and related products) are paid products. Prices, taxes, and shipping costs are shown at checkout before you confirm your order. Because printed products are personalized to your content, please review your storybook carefully before submitting a print order — refer to our Refund Policy for details on cancellations, defects, and returns.

Printing, production, and shipping of physical keepsakes are fulfilled for us by Gelato, an independent print-on-demand partner. When you place a print order, Gelato produces and ships it on our behalf using the storybook file you approved. Gelato's handling of your order (including production, shipping timelines, and their own returns process) is additionally governed by Gelato's own Terms of Service and Privacy Policy. By ordering a printed product through OMEMRA, you acknowledge that the User Content in your order will be shared with Gelato solely to produce and ship that order.

The OMEMRA name, logo, website design, and underlying software are owned by OMEMRA and protected by intellectual property law. Nothing in these Terms transfers any OMEMRA intellectual property to you, except the finished storybook or keepsake product you've purchased, which is yours to keep, print again for personal use, and share as you wish.

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information and the memories you share with us.

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied. OMEMRA does not guarantee that the Service will be uninterrupted, error-free, or that AI-generated content will meet your expectations. Nothing in this section limits any warranty that cannot be excluded under applicable law.

To the fullest extent permitted by law, OMEMRA and its officers, employees, and partners will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of content, arising from or related to these Terms or the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.

You may stop using the Service and delete your account at any time from your account settings. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ends, though we'll handle any remaining data in line with our Privacy Policy.

We may update these Terms from time to time. If we make material changes, we'll notify you by email or through the Service before the changes take effect. Continued use of the Service after changes take effect means you accept the updated Terms.
